STATUTE

OF THE

ITALIAN MARXIST- LENINIST
COMMUNIST PARTY


PREAMBLE


The Italian Marxist-Leninist Communist Party is the political organization of advanceguard of the working class and of all the workers, who, in the mind of the glorious Revolution of October, of the Resistence and of the proletarian internationalism and in the reality of the struggle of class, struggle for the indipendence and the freedom of the country, for the elimination of the exploitation of the man over the man and for the building of the Socialism in Italy and in the whole world.
The Italian Marxist-Leninist Communist Party was formed in 1921, at the Congress of Leghorn, considering the experiences of the italian and international working movement, the teachings of Marx and of Lenin and with the impulse given to the wordly working movement by the glorious Revolution of October. It groupped within its own organization the most advanced part of the Italian Socialist Party, of which it gathered the best traditions. With its constitution the Italian Marxist-Leninist Communist Party has given to the workers, to the men of mind and to the masses of the exploiteds an organizative, political and ideal guide in the struggle for the Socialism.
The Italian Marxist-Leninist Communist Party has opposed itself courageously to the fascist criminal tyranny, has struggled in all the ways inside the country, in the civil war of Spain, in the european Resistence and over the fields of battle where the fascism led its attack to the freedom and to the indipendence of the peoples; it has promoted, against the fascism and the hitlerian invader, the national, antifascist and popular unity, it has participated in decisive way to the direction and to the victory of the war of liberation.
Delivered the country and liquidated the fascist and monarchic regime, the Italian Marxist-Leninist Communist Party, has fought firmly against the opportunist, revisionist and trotschist deviations developed inside the italian left and affirming coherently the principles and the revolutionary and of class strategy of the Marxism-leninism, as only historically accessible direction for the victory of the proletarian Revolution, of the building of the Socialism and of the edification of the Communism.


Article 1

THE ITALIAN MARXIST-LENINIST COMMUNIST PARTY

The labourers, the workers and the intellectuals of advanceguard who work for the building of the Socialism in the italian society produce a voluntary and revolutionary organization of struggle of class: the Italian Marxist-Leninist Communist Party.
The Italian Marxist-Leninist Communist Party is established.
The Italian Marxist-Leninist Comunist Party inspires itself, in its work, to the theory of the Marxism-leninism or else to the Marx, Engels, Lenin and Stalin immortal mind and work.
The Italian Marxist-Leninism Communism Party is based on the following principles:
1. In the present capitalistic social regime and on its imperialistic globalization develops an always growing contrast between the productive forces and the relations of production, giving origin to the antithesis of interest and to the struggle of class between the proletariat and the dominating bourgeoisie.
2. The present relations of production are protected by the power of the bourgeois State, that, founded upon the representative system of the bourgeois democracy, represents the mean for the defence of the interests of the capitalistic class.
3. The proletariat can not violate and modify the system of the capitalistic relations of production, from which it derives its exploitation, without the cutting down of the bourgeois power.
4. The indispensable mean of the revolutionary struggle of the proletariat is the class political party, formed by revolutionary high members. The Italian Marxist-Leninist Communist Party, having within itself the past most advanced and conscious of the proletariat, unifies the efforts of the working masses, turning them from the struggles for the interests of groups and for contingent results to the struggle for the revolutionary emancipation of the proletariat; it has the task to diffuse in the masses the revolutionary and class conscience, to organize the material means of action and to direct in the development of the struggle the proletariat.
5. The victory of the proletarian revolution, the building of the Socialism, and the edification of the Communism are possible only with the strong and continuous struggle to the revisionism, to the trotskism and to each form of opportunism and of economicism.
6. After the cutting down of the bourgeois power, the proletariat cannot organize itself in dominanting class only with the destruction of the bourgeois State apparatus, and with the instauration of its own dictature, that is, basing the elective representations of the state about the only productive class and excluding the bourgeois class.
7. The form of political representation of the proletarian State is the system of the councils of the workers (workers of the industry, of the agriculture, of the handicraft, of the tourism, of the public Being , of the commerce, of the conveyances, of the telecommunications, of the information and of the tertiary in the main) already in action in the Revolution of October and in those succeeding and in the countries of the carried out socialism, particularly of the URSS, and before stable realization of the proletarian dictature.
8. The necessary defence of the proletarian state against all the counterevolutionary attempts.
9. Only the proletarian State will be able systematically to carry out all the succeding measures of intervention in the relations of the social economy by which the replacement of the capitalistic system will be carried out by the collective management of the production and of the distribution.
10. By effect of this economical transformation and of the consequent transformations of all the activities of the social life, eliminating the division of the society by classes, it will go also in eliminating the needs of the political state, whose structure will be progressively reduced to that one of the rational administration of the human activities.


Art. 2

THE MEMBERS OF THE PARTY

All the honest workers of both the sexes who reached 18 years of age may join the Italian Marxist-Leninist Communist Party. Each member of the party is obliged to accept the political program and the statute of the party, to work in one of its organizations and to pay regularly the ticket and the established enrolment fees.


Art. 3

THE APPLICATION

The individual application to the party must be presented in writing and have all the biographic informations that are required. It must present the subscription of at least two members of the party, who, guaranteeing the moral and political honesty of the requirer, are obliged to supply on their account the necessary informations. The guaranty must be motivated in writing and the guarantees must have at least one year of age of party.
The application to the party of a young belonging to the FGCIM-L (Italian Communist Marxist-Leninist Youthful Federation), instead that by two members of the party, must be presented by the committee of the cellule or of the section of the FGCIM-L to which the young belongs.
The passage is not automatic; in order that this takes place it always needs the approval of the cell of the section of party to which the question has been turned.
The application to the party becomes operative after a period of candidature of one year from the presentation, indispensable for the knowledge of the program, of the statute, of the strategy and tactics of the party and for the control, by the organizations of the party, of the personal qualities of the requirer. During such period of canditature, the candidate participates to the meetings of the organization of which he does part with right to consultive vote. The candidate for member of the party pays regularly the enrolment fees.


Art. 4

PRESENTATION OF THE APPLICATION

The application to the party must be presented to the directive committee of the cell of the place of work of the requirer where this is existent, or of the nearest street or village cell, or where missing, to the corresponding section committee.


Art. 5

EXAMINATION AND ACCEPTATION OF THE APPLICATION

The application to the party is examinated by the committee of party to which it has
been presented and this submits it, espressing the favourable opinion or contrary to the acceptation, to the assembly of the cell or of the interested section. Each comrade has the right to ask explanations and to do observations. Put in voting by hand up, the request to list is accepted if vote for its acceptation at least the two thirds of the presents.
If the the vote expressed by the assembly doesn’t give a majority of two thirds or it is contrary to the opinion expressed by the directive committee, this has the authority to put the question to the higher decision of the directive committee. To initiative of this it happens, in this case, a second assembly of the cell or of the interested section and the vote of this second assembly, for which are effective the rules of the first, is definitive.


Art. 6

ISSUE OF THE MEMBERSHIP CARD - SENIORITY

The membership card of the party is issued by the directive committee of the section. The seniority in every case begins from the acceptance day of the request for the enlistment by cell or section assembly to which it was presented.


Art. 7

SPECIAL CONDITIONS FOR THE ENTRANCE IN THE PARTY

For the admission of those ones who have covered political directive appointments in other parties it is obligatory, before the vote of the assembly of cell or of section, the opinion of the federal committee.
The same is valid for those ones who being already enlisted to the party, have left it or have been striked from the list.
If the vote of the assembly is contrary to the opinion of the federal committee, it may appeal to the Direction of the party, whose decision is obligatory and definitive.
For the admittance of political personalities coming by other parties that have a national evidence, or for the readmittance of those ones who were expelled from the party for reason of unworthiness or for strong political reasons, it is obligatory the opinion of the Direction of the party and of the central Commission of control.
If this opinion is conflicting with the expressed vote by the assembly that has deliberated about the request to list, the Direction submits the case to the central Committee, whose decision is obligatory and definitive.
In cases of particular political importance the collocation can be presented directly to the Direction of the party that will resolve on it referring it to the central Committee.


Art. 8

CHANGE OF RESIDENCE

The member of the party that for any reason changes residence is obliged to inform the directive committee of his organization that informs, in writing, the directive committee of the organization of the place where he moved and it releases to the requestor a presentation document.
No transfer can be accepted if the requestor is not furnished with this document of the organization of origin.


Art. 9

UDTIES OF THE MEMBERS TO THE PARTY

Except the disposals of the art.2, each member to the communist party is obliged:
a) to participate regularly to the meetings and to all the activities of the party, according to the directions of the organization to which he is enlisted; to carry out on his field of activity the political line of the party;
b) to improve continuously his own knowledge of the political line of the party and his own ability to work for its application; to work restlessly for the elevation of his own revolutionary and of class conscience with the assimilation of the principles of the Marxism-leninism;
c) to observe scrupulously the discipline of the party;
d) to have relations of brotherly solidarity with the other members of the party;
e) to have a honest, exemplary private life;
f) to practise the criticism and the autocriticism for the improvement of his activity and of that one of the party;
g) to be vigilant and to defend the party against each attack;
h) to do with the word and with the example continual work of proselytism.

Art. 10

RIGHTS OF THE MEMBERS TO THE PARTY

Each member to the communist party has right:
a) to contribute to the elaboration of the line of the party taking part to the discussions and deliberations of the organization to which he is enlisted;
b) to intervene in the discussion of all the questions on the agenda of the organization to which he is enlisted and to take part to the decisions with deliberative vote;
c) to participate with deliberative vote to the election of the leaders of his own organization and of the delegates to the congresses of section, of regional and provincial and regional federation and to the national Congress;
d) to be eligible to any charge of party and to be eligible as delegate to the congresses of section and of regional and provincial federation and to the national Congress according to the modalities fixed in the present statute;
e) to be, in case of disciplinary lack, judged by a regular organism of party and have the possibility, in any case to call on the assembly of its organization or on the central organs of the party;
f) to have from all the comrades a treatment of brotherly solidarity.


Art. 11

STRUCTURE OF THE PARTY

The Italian Communist Marxist-Leninist Party is organized in cells, sections, regional and provincial federations.


Art. 12

THE CELL

The cell is the organization of basis of the party. It can be formed:
a) on the working place (factory cell, of yard, of laboratory, of firm, of school, of office, of agricultural firm, ecc.);
b) territorially, according to the dwelling place of the members (street cell, of quarter, of building, of fraction, of village, ecc.).


Art. 13

THE CELL ON THE WORKING PLACE

The cell formed on the working place is the normal form of the organization of the party.
It includes all the comrades that are occupied in the same working place.
The comrades that belongs to the cells of working place are obliged to participate also to the activity of the territorial cells of their dwelling place as aggregated members.


Art. 14

SUBDIVISION OF THE CELL IN GROUPS

When the cell formed on the working place is too numerous because its activity can to be efficiently handled by the directive committee, it is subdivided in corresponding groups to the single departments, to the single offices or to the single turns of work. Each of these groups will have its directive committee, elected on the democratic way, that it will remain however subordinated to the directive committee of the cell. That acts as leading organ of all the cell, who remains, as such, the unitary formation of basis of the party.


Art. 15

THE TERRITORIAL CELL

The cell established on territorial basis includes the comrades that live in the same building, or street, or quarter, or village.


Art. 16

THE YOUTHFUL GROUP

The members to the party that have less of twenty five years of age can establish within their cell or section, a group of youthful work that has the task to organize and to develop the necessary work among the young men, under the direction of the corresponding organs of work of the directive committee of the cell, of the section and of the federal committee.


Art. 17

THE FACTORY OR FIRM COMMITTEE

On the working places where there are more cells, a work or firm party committee is established which coordinates and manages the activity and the action of the party in the same firm.
Such factory or firm committee is composed as a rule by the secretaries of the cells of the firm. When the cells are numerous, the secretaries of the cells designate, in agreement with the section committee, the components of the factory or firm committee.
The firm committee will designate his own secretary in accordance with the committee of section.


Art. 18

THE SECTION

The section is the organism of party immediately higher to the cell. It is formed by the cells of working place and territorial existent in its territory.
The section has a standing headquarters, which is the place of meeting and of resort of the comrades that lead to it. The headquarters of the communist section must become centre of political cultural and charity institution activity for all the workers of the locality.
In case of need, can be formed subsections.


Art. 19

THE COMMUNAL COMMITTEE

A communal committee is established in the communes which are not headquarters of federal committee, and if exist more sections.
The communal committee is designated by the federal committee. As a rule it is composed by the secretaries of section and can belong to it comrades having tasks in the institutional elective assemblies and in the organizations of mass.


Art. 20

THE AREA COMMITTEES

The sections of the party can be groupped in areas formed by more communes and managed by an area committee.
The area committee is designated by the federal committee, heard the section committees.


Art. 21

THE FEDERATION

The federation is formed by all the existent sections and cells in the territory of its competence and manages them.
The federation as a rule is provincial.
In a province can be established two or more federations for decision of the Direction of the party.


Art. 22

THE COMMITTEE OF THE REGIONAL FEDERATION

The committee of the regional federation, or the regional committee, has the task to carry out, in the region, the general line of the party and in this situation to elaborate the politics of the party to regional level, performing in all respects the handling and the control of its execution.
It represents the principal medium through which the national leading organs connect with the peripheric organizations and manage them, fast remaining the need of direct connections of the national centre with the federations.
The regional committee cojoins within itself the double function and characteristic of decentralized organism of the national direction and of organism democratically declared by the organization of the region.
The regional committee elects the secretary, the secretary’s office and it can elect a directive organism; it organizes its work so to assure the direction and the coordination of the initiative of the party in all the fields of the regional political activity.


Art. 23

THE DEMOCRATIC CENTRALISM

The internal life of the communist party is governed according to the principles of the democratic centralism. That means:
a) that all the leading organisms are elected democratically by the members to the relative organization;
b) that all the leading organisms have the engagement to relate periodically to the members in the organizations that they manage, near their activity;
c) that all the leading organisms and the single members of it are always revocable by decision of those that are vested of their mandate;
d) that closed the discussion and taken a decision, this is obligatory for all the members and for all the dependent organisms. The minority must accept and apply the decisions democratically taken by the majority with regular deliberation;
e) that it is not tolerated in the party the constitution of fractions which break the unity of the same party or call in question the discipline of it;
f) that the decisions of the higher organisms have obligatory character for the lower organisms.


Art. 24

ACTIVITIES OF THE ORGANIZATIONS OF THE PARTY

Each organization of the party has the right and the duty to treat and to resolve, in the ambit of the political line of the party and of its own initiative, all the political matters and of organization that occur it or interest it and to take position on all the questions of the national politics and of the international working movement.
It has the duty to apply the directives and the instructions of the higher organisms and to proceed actively to the recruitment and to the framing of new members and to the political formation of managing groups.


Art. 25

THE ASSEMBLIES OF THE MEMBERS

For each cell, both of work and territorial, the highest organ of deliberation and decision is the general assembly of the members, which must be convoked regularly by the directive committee of cell. For the section, the general assembly of the members takes place, with deliberative functions, only in those cases where the section is not subdivided in cells.
All the sections, also if subdivided in cells, can however convoke general assemblies of the members for information and consultation. The votes expressed by these assemblies have only consultive value. The directive committees of the most numerous cells, of the sections and of the federations, can convoke besides, for information and consultation, meetings of comrades, namely that it have in the party or in the organizations of mass appointments or tasks of work; the orders of the day approved in these meetings have consultive value.


Art. 26

THE CONGRESSES

For the section, for the provincial and regional federations and for the party on its whole the highest deliberative organ, which decisions are obligatory for all the members and for all the subordinated organizations, is the congress, respectively of national, regional and provincial section.


Art. 27

ELECTIONS OF THE DIRECTIVE COMMITTEES AND CONDITIONS OF ELEGIBILITY

The directive committees are elected with direct and nominative vote.
The directive committee of cell is elected by the assembly of cell. The directive committee of section, the federal committee, the regional committee and the central Committee are elected by the relative congresses.
It can be elected as members of the committee of section all the comrades that have a seniority of party of at least one year , as members of the federal committee all the comrades that have a seniority of at least two years, as members of the regional committee all the comrades that have a seniority of at least three years, as members of the central Committee and of the central Commission of control all the comrades that have a seniority of at least four years. In exceptional cases this rule may be derogated by decision of the superior organism.
The directive committees control and manage the political activity and of organization of the relative formation of party between a congress and the other and their decisions must be respected and applied by all the comrades except the right of claim to the highest organs.


Art. 28

THE DIRECTIVE COMMITTEE OF CELL

The directive committee of cell is elected by the general assembly of the members of the cell.
For the election of the directive committee the assembly elects preliminarly the Presidency, which in the course of development of the same assembly practises the functions and has the powers of the directive committee.
The vote is direct and nominative. The committee is as rule totally renewed by election each year.
When one more seats are vacant a partial election is provided..
The committee includes three or more members among which a political secretary, a secretary of organization and an administrator, designated by the same committee in its own bostom taking into consideration the indications eventually given by the assembly.
The committee manages all the work of the cell and it is responsable for the application, by it, of the line of the party. It must control the execution of its own decisions and of those of higher organisms that concern it
It appoints the comrades responsable for the different branch of work of the same cell and controls the activity of it. It answers in common for its proceeding to the assembly of the members and to the directive committee of the section and of the provincial federation.
The members of the committee of cells are considered barred after three unjustified consecutive absences from the sessions of the committee of cells.


Art. 29

CONGRESS OF SECTION

The congress of section is formed by the representatives of the cells, elected by these, according to the established rules by the directive committee of the federation, in proportional number to the members. It convokes itself at least once a year to elect the directive committee of the section and to debate the other subjects put on its order of the day. It can be convoked extraordinarily for decision of the directive committee of the federation or for suggestion to this turned from the Direction of the Party, or on request of two thirds of the members, previous consent of the directive committee of the federation.
The congress elects preliminarily the Presindency, that in the period of course of the same congress practises the functions and it has the powers of the directive committee.
The congress of section, with direct and nominative vote, elects the directive committee of five or more members. It elects also the candidate members, in the measure of a third of the components of the directive committee, that according to the chronologic order of the list, in case of withdrawal of some members of the directive committee the composition of it is completed by the number of the members candidate elected by the congress.


Art. 30

THE DIRECTIVE COMMITTEE OF SECTION

The directive committee of section elects within, taking into account the eventual indications of the congress of section, a political secretary, a secretary of organization, an administrator, a responsable for the propaganda and a responsable for the work of mass.
It controls the work of the cells and it is responsable for all the activity that occurs in the territory of the section.
It must control the executions of the decisions of the congress, of its own decisions, and of those of higher organisms.
It can form, for the best organization of its activity, some commissions of work (for the propaganda, the organization, the development of the high members, the press,ecc.). Also comrades who are not part of the directive committee may be called to take part of the working commissions.
The directive committee of section is responsable in common for its work as much as towards the congress of section as many as towards the directive committee of the federation.
The members of the directive committee of section are considered barred after three unjustified consecutive absences from the sessions of the directive committee of section.


Art. 31

THE CONGRESS OF THE PROVINCIAL FEDERATION

The congress of the provincial federation is, in the territory of the province, the highest decision of the party.
It reunites once each two years and fixes its own order of the day.
The congress elects preliminarly the Presidency, that in the period of course of the congress practises the functions and it has the powers of the federal committee.
On request of the majority of the sections and of the cells or of the Direction of the party or for decision of the federal committee may be convoked some extraordinary congresses.
The call of the extraordinary congresses must be ratified by the Direction.
The Direction of the party can decide that a specific subject to be treated in the day.
It participate to the congress the elected by the organizations of basis delegates in proportional measure to the members according to the rules established by the directive committee of the federation.
The congress of the provincial federation elects, with direct and nominative vote, the federal committee of 15 or more members. It elects also the candidate members, in the measure of a third of the components the federal committee, that according to the chronologic order of the list, in case of withdrawal of some members of the federal committee the composition of it is completed from the number of the candidate members elected by the congress.


Art. 32

THE CONFERENCE OF THE PROVINCIAL FEDERATION

The conference of the provincial federation is the meeting of the representatives of the communist organizations existent in the territory of the same, designated by the directive committees of these organizations according to the rules established by the directive committee of the federation.
It discusses the subject to be treated in that day by the directive committee, in agreement with the Direction of the party.
As a rule, the conference of the provincial federation has not power to elect new leading organ of the federation. Such power can be awarded to it, in case of need, by the Direction of the party, of the directive committee of the same federation.


Art. 33

THE FEDERAL COMMITTEE OF THE PROVINCIAL FEDERATION

The federal committee of the provincial federation is the organ of direction of the activity of the federation in the period included between one or the other congress.
The election takes place for direct and nominative vote according the rules of voting fixed by the same congress.
The federal committee controls the activity of all the sections and cells of the province. It is kept to control scrupolously the execution of its own decisions and it is responsable for the right application of the line of the party in all the province. It manages the provincial press, of which it appoints the directors and the editors.
The federal committee elects within a political secretary that represents the party, a secretary’s office of three or five members, among which must be present a responsable for the organization and an administrator, and an executive committee. Besides it forms, according to the needs, some commissions of work (for the organization, the propaganda, the formation of the high members, for the youthful, feminine, syndacalist work, ecc.) of which it designates the responsables and it supervises the activity.
Also comrades who are not part of the directive committee may be called to take part of the working commissions.
The federal committee is responsable in common of its work towards the provincial congress and towards the Direction of the party and the central Committee.
The members of the federal committee are considered barred after three unjustified consecutive absences from the sessions of the federal committee.


Art. 34

THE CONGRESS OF THE REGIONAL FEDERATION AND THE REGIONAL COMMITTEE

The congress of the regional federation is formed by the delegates elected by the congresses of the provincial federations in proportional measure to the number of the members and according to the rules established by the regional committee on agreement with the Direction of the party.
The congress of the provincial federation meets every four years, at a distance of two years from the national congress. It is convoked by the regional committee to debate the relation about the activity of the same committee and the other questions to be treated in that day. The Direction of the party can decide that on the order of the day of the congress of the regional federation are placed specific subjects.
The components of the vacating regional committee, if they are not delegated to the congress, partecipate there, they have right of word, but not of vote. During the course of the congress, the presidency practises the functions of the regional committee.
Extraordinary Congresses of the regional federation, can be convoked for decision of the central Committee or of the Direction of the party, or on request motivated by the majority of the federations that group at least one third of the members, or for decision of the regional committee, previous consent of the Direction of the party.
The congress of the regional federation elects, with direct and nominative, the regional committee of 15 or more members. It elects also the candidate members, in the measure of one third of the components the regional committee, that according the chronological order of the list, in case of withdrawal of some members of the regional committee the composition of it is completed by the number of the candidates elected by the congress.
The regional committee is responsable towards the central Committee, the Direction of the party and towards the regional congress, of the execution of the congress decisions of the congress and of the political line of the party in its own organization.
It manages the regional press, of which it appoints the directors and editors ; it controls the activity of all the lower organisms; it forms its own commissions of work designating the responsables and the components of it and controlling the activity of it.
At least once a year the regional committee must heard and discuss a relation about the activity of the elected communists in the institutional elective assemblies. The regional committee must reunite itself normally at least once a month.
The members of the regional committee are considered barred after three unjustified consecutive absences by the sessions of the regional committee.


Art.35

THE CONFERENCE OF THE REGIONAL FEDERATION

The conference of the regional federation is the meeting of the representatives of the communist organizations existent in the territory of the same, designated by the directive committees of these organizations, according to the rules established by the directive committee of the regional federation.
It debates the questions set on its order of the day by the directive committee of the federation on agreement with the Direction of the party.
As a rule, the conference of the regional federation has not power to elect new leading organs of the federation. Such a power may be allotted to it, in case of need, by the party Direction, on request of the directive committee of the same federation.

Art. 36

THE CONGRESS OF THE PARTY

The leading highest decision of the party is the national Congress, that is convoked for decision of the central Committee not less than once every four years and includes the delegates elected democratically by all the provincial federations, proportionally to the members and according the rules established by the Direction of the party.
The Congress decides its order of the day, and elects its own directive organs. The Presidency of the Congress elected preliminarly and in the period of the course of the same Congress practises the functions and it has the powers of the central Committee.
The Congress fixes the political line of the party, judges the activity of the central organs of direction and of the formations of basis, and it elects, with direct and nominative vote, according the rules and in the number of members that it same establishes, the central Committee and the central Commission of control. It elects also the candidate members, in the measure of one third of the components the central Committee and the central Commission of control, that, according to the chronological order of the list, in case of withdrawal of some members of the central Committee the composition of these organisms is completed by the number of the candidates elected by the congress.
The decisions of the Congress are obligatory for all the party.


Art. 37

THE CENTRAL COMMITTEE

The central Committee manages the party in the period among two congresses.
It elects within:
a) The general secretary and one or two assistant general secretaries of the party;
b) the Direction of the party which appoints the number of the real and supply members, and to which is entrusted the current handling of all the activity of the party.
The Direction of the party, in turn, appoints:
a) the Secretery of the party as organism that assures the continuity of the political and organizative work of the Direction, the execution of its decisions and the dispatch of the current affairs;
b) the commission of organization;
c) the responsables of the commissions of work established near the central Committee;
d) the directors of the newspapers that have function of central organism of the party;
The central Committee can appoint a special Commission with the task to elaborate some proposals of partial modification of the statute of the party to show at the congress.
The call of the central Committee is done by the Direction of the party and it must happen as a rule every three mounths.


Art. 38

THE CENTRAL COMMISSION OF CONTROL

The central Commision of control has the task:
a) to help the Secretary’s office and the Direction of the party in the control about the application of the statute and about the well working of the same party;
b) to follow the activities of the schools of party both central and regional and local in order to better assure the development and the marxist-leninist ideological formation of the high members of party;
c) to verify the budget of the party;
d) to judge the charges brought against the personal honourableness and the behaviour of the members of the central Committee, of the secretaries of the provincial and regional federation and of the communist deputies and senators into office.
The central Commission of control has the right of decision about all the questions of which to the point d) and about all the other questions of disciplinary type that are subjected to it from the Direction and from the central Committee of the party. For all the others it has right to propose suggestions and measures that will assume executive value only after the approval of the Direction or of the central Committee of the party.
The central Commission of control elects within an office of Presidency of five members, of which one president.


Art. 39

NOMINATIONS

Outside the elections in the established forms by the previous articles, some comrades may be called to be part of the directive organisms of the party, of all the request, for the decisions of these same organisms.
It applies to this designation for exceptional political important cases. In any case this designation can not concern more than a fifth of the members of the interested leading organism and in all the cases, except the central Committee, it must be sanctioned by the immediately higher leading organism for the validity of the designation is requested in any case the qualified majority of two thirds.

Art.40

THE NATIONAL COUNCIL

In the interval among two congresses, in order to consult the party about questions relating its general political action, the central Committee can convoke the national Council of the party, to which it belongs, besides the effective members and candidates of the same central Committee, the secretaries of the provincial and regional federation and the members of the central Commission of control.To the national Council can be invited the comrades elected in the institutional elective assemblies.


Art. 41

THE CONFERENCE OF THE PARTY

In the interval among two congresses, the central Committee can convoke some national Conferences of which it establishes the order of the day, and to which the provincial and regional federation committees delegate their representatives according the instructions that it will be issued time after time.
Both the deliberations of the conference and those of the national council have consultive value and become executive only after the ratification of the central Committee.


Art. 42

ELECTIVE PUBBLIC APPOINTMENTS

The choice of the candidates of the party to the political and administrative elections is based on rules which are fixed by the central Committee or for it by the Direction of the party.
The members of the party designated to elective pubblic appointments are responsable for their mandate both towards the party that have designated them and towards their electors and the popular mass that they represent.


Art. 43

HEAP OF APPOINTMENTS

Even though there isn’t any incompatibility among the several elective and representative party appointments it will be as a rule avoided the heap of too many appointments in only one person.


Art.44

THE COMMUNISTS IN THE SYNDACALIST ORGANIZATIONS

All the members of the party must on obligatory way be enlisted to the respective syndacalist organizations of class.
Near the Central Committee of the party is formed a syndacalist committee whose members are appointed by the same Central Committee and which has the leadership of the syndacalist activity of the communist party.


Art. 45

THE ITALIAN MARXIST-LENINIST COMMUNIST YOUTHFUL FEDERATION

The young people from 12 to 18 years of age who are oriented towards the ideals of the Socialism, organize themselves into the Italian Marxist-Leninist Communist Youthful Federation, political organization of class of the youth that under the direction of the party educates the young people to the cause of the Socialism.
In order to know better the problems of the youth and to make easy the work of direction in the FGCIM-L at each organizative level, the party designates its representatives in all the leading organisms of the FGCIM-L and it assembles in its own leading organisms the representatives of the FGCIM-L in the number that will be established.
The central Committee of the FGCIM-L delegates to participate to the works of the central Committee of the party of its members.


Art.46

THE UNITY OF THE PARTY

The unity of the party is essential guaranty for the realization of its program, for the victory of the working classes and of the people in the struggle for the Socialism.
All the formations of party and all the comrades are obliged to defend the unity of the party against each attempt of disaggregation or of fraction activity.
The constitution of fractionistic groups within the party is rigorously prohibited and it is injured with sanctions that can reach until the expulsion.


Art.47

THE STRENGTHENING OF THE PARTY

The party strengthens itself not only by increasing the number of its supporters and exalting the political and ideological ability of it, but taking constant care that don’t enter neither remain on its lines elements that bring discredit on the same party, for their behaviour, or have given or give proof of vileness, or are in any way neither agents of political enemies of the party or vehicle of the influence of these ones within its organization.
To defend the party by each form of opportunism, of revisionism, of trotschism is duty that cannot be disregarded by each member.


Art.48

DISCIPLINARY SANCTIONS

The communist that fails in his duties towards the party is punished with the following sanctions:
a) The oral call;
b) The writing blame with or without degradations from the appointments;
c) the dismissal from the appointment;
d) the suspension from one to six mounths;
e) the radiation;
f) the expulsion;
The oral call and the blame are inflicted by the leading organisms of the party.
The other sanctions are decided by the assembly that is qualified for the acceptation of the list and with the same majority. The removal from the appointment, the suspension, the radiation and the expulsion will be effective only after the ratification of the directive committee of federation, and in the graviest cases after the ratification of the central Committee.
The comrade submitted to disciplinary procedure has right to the specific objection of the charges and to the defence. He can appeal to the directive committee of the organization higher than that one that has taken the necessary measure and in any case to the Direction of the party and to the central Committee.
All the sanctions can be issued.


Art. 49

THE FINANCES OF THE PARTY

The financial means of the party are provided by the proceeds of the membership cards and by the contribution paid by the membership, by voluntary subscriptions and offers, by the proceeds of feasts, popular lotteries, loans, ecc.
The cells, the sections, the provincial and regional federations are, from administrative and patrimonial standpoint, distinguished entities among them besides towards the Direction of the party, which is not legally responsable for their administrative activity.
The membership card is annual and its price is established every year by the Direction of the party, which fixes also the amount of the shares and the measure of the distribution of the revenue of the membership card and of the shares among the peripheric organizations and the central organization.
Each organization of the party must keep a regular administration of its funds.


Art. 50

SYMBOL, FLAG AND HYMNS OF THE PARTY

The symbol of the Italian Marxist-Leninist Communist Party, in gold colour, is formed by the star with five heads, symbol of the proletarian internationalism, placed standing above the hammer and the sickle, between them, symbol of the proletarian work.
Under the symbol are embroidered, in gold colour, the words “PCIM-L”.
The flag of the Italian Marxist-Leninist Communist Party is a right angle of red cloth, whose basis is one and half the height. On its higher left angle it presents in gold colour the star with five heads, symbol of the proletarian internationalism, and the symbols of the work, the sickle and the hammer.
Under these symbols horizontally are embroidered, in gold colour, the words “PCIM-L”.
In the public manifestations the flag of the party must be always carried and exhibited by their own organizations.
In the assemblies of party are executed as hymns of the italian workers the “Hymn of the workers”, “Red Flag” and the “International”.
